American Legion Commander to Berkeley City Council: ‘Marines are not the enemy’

"Osama bin Laden couldn't have said it better," American Legion National Commander Marty Conatser said of the Berkeley City Council Resolution, which tells the Marines that they are not welcome there. "Disgraceful, disloyal, ungrateful. These words are too kind in describing the actions of the public officials in Berkeley, who voted for this disgrace. Nonetheless, our Marines continue to bravely serve and in so doing, allow Americans to spout such foolishness. The American Legion not only strongly condemns this action by the City Council but also believes that a sincere apology is in order to all Marines, past and present."

Conatser, the leader of the nation's largest veterans organization, was referring to a measure passed by the Council 6-3 Tuesday, that tells the U.S. Marine Corps that one of its recruiting stations is "not welcome in the city, and if recruiters choose to stay, they do as uninvited and unwelcome intruders."

The City Council marched in complete lock-step with radical anti-war group Code Pink in attempting to drive out Marine recruiters from its San Francisco suburb. The City Council also voted 8-1 to give Code Pink a free parking space in front of a recruiting station, along with a free sound permit for protesting once a week. Marine recruiters at Berkeley have faced harassment from protestors who regularly block nearby sidewalks, generate excessive noise and disrupt business.
"I have been a recruiter in the National Guard and I know that it's tough duty, with long hours," Conatser said. "What these recruiters do is essential to our national security. Without recruiters we have no military. And I don't think we can count on the flower children from Berkeley to protect this nation when it comes under attack. They have to remember that Marines are not the enemy; the terrorists are."

Conatser pointed out that The American Legion strongly supports the war on terrorism, passing a national resolution of its own. "Resolution 169 was passed unanimously by The American Legion in 2005 and it has been re-affirmed every year since. It reminds Americans that you can not separate the war from the warrior and that the American people should stand united in support for our troops who are engaged in protecting our values and our way of life."
With a current membership of 2.7-million wartime veterans, The American Legion, www.legion.org, was founded in 1919 on the four pillars of a strong national security, veterans affairs, Americanism, and patriotic youth programs. Legionnaires work for the betterment of their communities through more than 14,000 posts across the nation.

I find what Berkeley is doing to be completely reprehensible and talking about it is not satisfying. While I work every day to make a better life for my children, a life made possible from the sacrifices of the U.S. Marine Corp and others in the military, I cannot afford to participate in a sit-in or other protests like these so-called Americans in Code Pink. But I will gladly pay to help those who are retired, especially retired veterans, or others who have the time to find lodging and transportation to protest, peacefully of course.

I think the American Legion needs to start showing how many people in this country love the Marines and all of the services. Let's flood Berkeley with veterans and bring that city to a halt. Imagine the coverage during the election year. Let's call it Code Red, White and Blue. I am a lawyer and will donate my services to defend anyone arrested for failing to disperse without charge or parks in the Code Pink parking space.

Shameful! Millions of men and women lost their lives so America can be free. A family member of mine died fighting in the Pacific for our freedoms, but I doubt he ever dreamed it would come to such a sad form of descrimination. The Council has no shame. The one vote for the Marines should commended. The sadness of it all is that a Marine would give his/her life for the scum which hates them so.


It is time for direct action against Berkeley. Actions that stretch the tolerance of a city that allows tree sitting and other illegal actions in the name of symbolic free speech.


Imagine the parking meter scene in Cool Hand Luke, upgraded with stealth and know-how. There must be many acts of civil disobedience an afronted conservative people might use to bring Berkeley or the Oakland Airport to a standstill. Even by Berkeley wacko left political standards, this current episode is completely over the top.

And to cap it off, today we learned about dozens of more dead innocent Iraqi's including the two Down Syndrone women used as suicide bombers. People like those in Code PInk and their ilk have blood on their hands with their anti-American, anti-military, pro-"Iraqi resistence" and pro-Al Qaeda positions.

We need continued and heavy national, Department, and post leadership on this and I join the call for our fellow members of the American Legion, and all other patriotic organizations in California, to descend upon Berkeley in a counter-protest and in support of the Marine recruiters.

If we were invaded by a hostile force the city counsel of Berkeley would be kissing the a****s of every Marine in a hundred miles. Why doesn't the governor of the state of California and the legislature censure them and the city. I would have no legal weight, but would make official notice of their lack of patriotism and loyalty to this country.

As "reprehensible" as this act appears to a segment of the population, we must also realize that these measures are deeply popular with the citizens of Berkeley and are thus a clear example of democracy in action. I personally wouldn't support such a measure but i respect both examples of civic activism from Code pink and The American Legion for practicing their 1st amendment rights.

I think you are confused about a couple of things S. Epstein. The 1st Amendment doesn't allow you to harass endlessly, doesn't allow you to disturb the peace with overtly loud protests, where one side is given extraordinary permissions and resources to conduct such harrassments, which from what I understand is physical intimidation. The city council approval of this doesn't make it democracy, Saddam Hussein had the approval of his council, also, because you can't have democracy without liberty for all and the city council isn't interested in liberty for all, just a select few. I'm not a political science major, but I do recognize oppression when I see it and that's exactly what is being demonstrated in Berkeley

U.S. Senator Wants to Revoke Funding From City of Berkeley, Calif., for Vote to Boot Marines

WASHINGTON — U.S. Sen. Jim DeMint, R-S.C., says the City of Berkeley, Calif., no longer deserves federal money.

DeMint was angered after learning that the Berkeley City Council voted this week to tell the U.S. Marine Corps to remove its recruiting station from the city's downtown.

"This is a slap in the face to all brave service men and women and their families," DeMint said in a prepared statement. "The First Amendment gives the City of Berkeley the right to be idiotic, but from now on they should do it with their own money."

"If the city can’t show respect for the Marines that have fought, bled and died for their freedom, Berkeley should not be receiving special taxpayer-funded handouts," he added.

Sen. DeMint will appear Saturday on FOX News Channel — on FOX Online With Jamie Colby — between noon and 2 p.m. ET.

In the meantime, a senior Marine official tells FOX News that the Marine office in Berkeley isn't going anywhere.

"We understand things are different there, but some people just don't get it. This is a part of the military machine that gives them the right to do what they do, but what they are doing is extreme," the official said.

DeMint said he will draft legislation to rescind any earmarks dedicated for the City of Berkeley in the recently passed appropriations bill — which his office tallied to value about $2.1 million. He said that any money taken back would be transferred to the Marines.

DeMint's office provided a preliminary list of items that would be subject to his proposal:

— $975,000 for the University of California at Berkeley, for the Matsui Center for Politics and Public Service, which may include establishing an endowment, and for cataloguing the papers of Congressman Robert Matsui.

— $750,000 for the Berkeley/Albana ferry service.

— $243,000 for the Chez Panisse Foundation, for a school lunch initiative to integrate lessons about wellness, sustainability and nutrition into the academic curriculum.

— $94,000 for a Berkeley public safety interoperability program.

— $87,000 for the Berkeley Unified School District, nutrition education program.

The Marine official, speaking with FOX News on Friday, said Marine Commandant Gen. James Conway scoffed at the news, but there are no plans for to protest the City Council's decisions. There are definitely no plans to move the recruiting station either.

"To actually put something into law that encourages the disruption of a federal office is ridiculous. They are not going to kick a federal office out of its rightful place there, and this is not going to discourage those young patriots who want to be Marines," the official said.

The Berkeley City Council this week voted to tell the Marines their downtown recruiting station is not welcome and "if recruiters choose to stay, they do so as uninvited and unwelcome guests," according to The Associated Press.

The council also voted to explore whether a city anti-discrimination law applies to the Marines, with a focus on the military's "don't ask, don't tell" policy that prevents open homosexuality in the military.

The council also voted to give the antiwar group Code Pink a parking space in front of the recruiting office once a week for six months, as well as a protest permit.

The Marine recruiting office in Berkeley has been open for about one year, but has been the subject of recent protests by Code Pink members.

On Jan 31, 2008 I wrote a letter to the Mayor of Berkeley stating my position regarding his and the City Counsel's position on the USMC recruiting station.
I passed that letter along to a couple of Marine handball buddies. They passed that email/letter to the guys who play in the Semper Fi handball tournament at MCRD, who passed it along to, who passed it along to, etc.
In my wildest dreams I never envisioned the response I have received. I now spend ALL DAY answering my cell phone acknowledging that yes, I really did write "THE" letter, and receiving personal thank yous from Generals, Majors, Colonels, SGTs, PVTs, CEOs, COOs, talk show hosts, and average everyday American Patriots.
Likewise I spend the balance reading emails from the same sort of people.
I am humbled to a degree that is hard to state clearly. I am emotionally overwhelmed with the positive response to my letter and want to thank everyone who has called me or emailed me to state their support.
My intention was never to shine the spotlight on me, it was to cause, to whatever degree I could, great fiscal discomfort to the city of Berkeley in retaliation to their un-American, cowardly and despicable stance that the US Marines are unwelcome, and uninvited intruders in their city.
If in my small way I helped light a fire that now appears to be blazing across the nation, I am proud of that, but I am more proud of the fact that I could , at a time when our heroes are fighting against those who would destroy us, help focus some attention to the vast debt, and undying respect, that we as a nation owe to the men and women of the United States Armed Forces.

A sad bunch of comments, most of which stridently attack the principles of free speech and that freedom that is so often invoked as a goal and result of military action.

The Marines fight for our freedom, but we dare not exercise any of that freedom--is that about it?

The picture says it all--the Marine is saluting the flag, and his back is to the People.

The city of Berkeley wants us all to believe that they (somehow) support the troops but are oppose the war. In the face of visual and transcribed eveidence that during the counsel meeting of Jan 29th, wherein they called the Marines, assassins & war criminals, they now expect us to let this pass by pretending that they did not say what in fact they did say.

For someone who is so impressed with themselves, you would do well to read the Declaration Of Independence and The US Constitution sometime...if you can find some 6th grade American History texts in Mexico. Let me help you with this.

Our freedoms weren't "bought" by anybody. Although the concept of "buying" freedom - and everything and everybody else - is something that's probably quite appealing to someone like yourself...especially if it involves killing and exploiting innocent people on the other side of the planet who have never invaded or done anything to us.

But at least paying for things instead of using our military to murder the rightful owners and pirate them is a step in the right direction.

In the meantime, maybe you would do better to find yourself a Tijuana Yellow pages to show everybody the impact of your boycott.

By the way, I've stayed at The las Palmas. I'm still waiting for the manager to find the Rolex I left in the room safe. I would beg to differ with your opinion that you are "the only group opposing the city counsels actions".
You might want to start by reviewing the multitude of addresses CC'd in this email in re-assessing that stance- well over 350. Next if you would like I could forward some of the 13,000 emails I have received from Americans all across the nation, Iraq and Afghanistan who have asked me to continue on with my/our boycott until Berkeley understands clearly that we will not stand for them calling the USMC (or any other branch of the armed services) "war criminals", "murderers", "assassins", etc.
YOUR high schools supplied (let them take off from school if they wanted to demosntrate against the Military) the foul mouthed children who I witnessed verbally assault elderly women by screaming "you Nazi c***t, get out of Berkeley", I watched two of their radical, hate filled teachers, whom your city pays to teach these kids, direct these indoctrinated charges to surround and verbally assault elderly veterans screaming the most vile profanities. Where were you while this abomination was going on. Where exactly were you voicing you opposition to the City Counsels position, from underneath your desk? You most certainly were not anywhere near the City Hall.

Dear friends,

While we thought that we were close to reaching our goal of getting an apology from the Berkeley City Council, it turns out that the City Council is far from apologetic. Quite the contrary they are now, at the next meeting 2/26/08, formulating a request to the Canadian Governement "to provide sanctuary for U.S. military service members who are living in Canada to resist fighting in the Iraq war" (deserters)! This newest outrage dictates that now more than ever, we need to keep severe economic pressure on the businesses and the Berkeley Chamber of Commerce.

After several strategy sessions with Duane "Dewey" Clarridge specifically about the goals of what was started back on January 31, when I first wrote the now (in)famous Letter to the Mayor of Berkeley, it has become obvious that we need to consolidate our disparite group into a cohesive entity that can apply intense economic pressure to not only Berkeley, but on Toledo, Ohio as well. (You all know what the Mayor of Toledo did in canceling the USMC urban training/maneuvers at the last moment in that city, citing numerous absurd reasons).

I am aware that there are several patriotic organizations actively pushing petitions which lambaste the City Council of Berkeley and are calling for it to " immediately revoke all the resolutions passed on January 29th, 2008 that defamed and insulted our U.S. Marines and issue a full public apology to this nation, and in particular, the honorable and heroic men and women of the United States military." Not the least of which is Move America Forward, with our good friend Melanie Morgan leading the charge for them, and another by Jay Seculo at the ACLJ .

However, I still believe and contend that the way to the "hearts and minds" of the citizens of Berkeley, who are responsible for duly electing the councilmen and women who have gravely insulted, belittled and besmirched our military, is through the ruination of that city's businesses both small and large by directly communicating to them and to the Chamber of Commerce our unrelenting intention to boycott each and everyone of them, and listing all the companies involved in our boycott, and list of names of all the men and women nationwide who back this economic boycott , and free speech movement.

This approach is bolstered by an email I recieved yesterday: As a former Executive Director for two local chambers of commerce, I can assure you that you certainly hit them where it hurt. While serving ..., I became aware that our local cities can ill afford to alienate their constituents, nor to jeopardize their businesses. D. T.

Only when the citizens of Berkeley walk up to the members of the City Council as they pass by on the street and say "Tom (Bates), you and the Council's stand/statements have destroyed our city, we are in economic ruin", will the City Council be forced by their constituents to issue an apology, and a commitment to cease colluding with and abetting ANY organization which impedes the recruiting efforts of U.S. Military recruiters.

To that end, I need all of you who are still with us in the Berkeley Economic Boycott to please respond to expobd@yahoo.com. Let us know if we can (or not) count on you to allow us to identify you and your company in letters to the Berkeley businesses and to the Chamber of Commerce so that they know we are acting as a group. One letter, backed and signed by the group as opposed to myriad letters which may or may not end up in the "circular file" disregarded and unread, will be much more effective. This letter needs to specify who is boycotting and how Berkeley and Toledo will be affected.

Action plan:

Create a boycott website

Prepare and post on the website a form letter to be used/signed by all those in agreement with the economic boycott. Te letter should state that the boycott will be lifted upon posting of a letter written by the City Council/Mayor apologizing to the U.S. Military and a commitment to cease colluding with and abetting ANY organization which impedes the recruiting efforts of U.S. Military recruiters.

Posting that letter to the Mayors and Chambers with no prior warnings.

Contact all businesses listed in the Chamber of Commerce in Berkeley and Toledo and inform them of the boycott/send letter.

I need to hear from you ASAP. These actions should get the attention of the Senators who are tip-toeing towards bringing the No Earmarks for Berkeley Bill to the floor for an up or down vote.

I also need your comments and suggestions as to a name for the new entity and general observations.

All Fed and State Aid to Berkeley should be stopped ASAP. Also the State of CA should remove from Berkeley the right to Tax ALL Current and former Military (Veterans) for the Benfit of Berkeley City and Colleges ASAP. This removal of the "Right to Tax" would include Property Tax and ALL money to support Cit y Services. The State should not provide any money to replacet his money. That way they would not have the money to do this CRAP. Also, the Military should Park Two Tanks in front of the Marine recruiting station. Also a List should be provided on all American Legion Dept's.(State) Web Sites that list all Companies that have Headquaters in Berkeley so we can all boycout the Companies.
