The American Legion is collecting cases of veterans whose third-party insurances were improperly billed by the Department of Veterans Affairs.

The Department of Veterans Affairs has the authority to bill health insurance companies for health care provided to nonservice-connected veterans who have private health insurance, as well as service-connected veterans treated for non-service conditions. VA can also collect copayments from nonservice-connected veterans based on income. If a veteran has a 50 or greater percent service connection, he/she is not responsible for paying a copayment for either medical visits or prescriptions. However, the veteran’s insurance may be billed by VA if their care is NOT related to a service connected condition.
